Driving with cannabis in Massachusetts

Almost everyone who buys cannabis in Athol drives away with it. Very few people know the rule that applies the moment they put it on the passenger seat.

There are two separate issues here and they carry very different weight. One is where the product is stored while you drive. The other is whether you are impaired while driving. The first costs money. The second is a criminal matter.

Storage: the open container rule

G.L. c. 94G, ยง 13 prohibits possessing an open container of marijuana in the passenger area of a vehicle. The civil penalty runs up to $500.

The two definitions that matter:

Open container means a package with a broken seal, or one that has been partially consumed. This is the part people get wrong. It does not mean open in the sense of currently open. A jar you opened a fortnight ago, resealed and put in the door pocket is an open container.

Passenger area means the area where the driver and passengers sit. The statute specifically excludes the trunk, a locked glove compartment, and the living quarters of a house coach.

An unopened, factory-sealed package from the dispensary is not an open container. Product you bought today, still sealed, is fine on the seat. It stops being fine the moment the seal is broken.

The habit worth building

Put anything with a broken seal in the trunk before you start the engine. Every time, without thinking about it.

The reason to make it automatic rather than situational is that the rule does not care about your intentions. There is no consumption element to the open container offence — the container being open in the passenger area is the whole of it.

If your vehicle has no separate trunk — a hatchback, a pickup, many SUVs — the locked glove compartment is the alternative the statute names. Locked, not merely closed. A cargo area behind the rear seats of a hatchback is not obviously outside the passenger area, and we would not rely on it.

Impairment is the serious half

Massachusetts treats operating under the influence of marijuana the same way it treats operating under the influence of alcohol. It is a criminal offence, not a civil one, and the warning printed on every package sold in the Commonwealth says so directly: do not operate a vehicle or machinery under the influence of this drug.

There is a practical complication worth understanding. There is no roadside test for cannabis impairment equivalent to a breathalyser. Blood and urine testing detects THC and its metabolites long after any impairment has passed, so a positive test does not establish impairment and an officer’s assessment carries correspondingly more weight.

The consequence for you is that "I was under the limit" is not a defense that exists here in the way it does for alcohol, because there is no limit of that kind to be under.

Timing, if you have consumed

The onset and duration figures we publish elsewhere on this site are directly relevant to this decision.

Inhaled cannabis takes effect within one to ten minutes and typically settles over one to three hours. Swallowed cannabis can take 30 minutes to two hours to arrive and can last four to eight hours or longer — and the delayed onset means it is entirely possible to feel unaffected at the point you decide to drive and not be unaffected twenty minutes later.

That is the specific scenario the statutory two-hour warning exists for. If you have taken an edible, driving is not a decision to make inside that window.

Crossing state lines

Athol sits close enough to the New Hampshire line that this comes up constantly. The short version is that taking cannabis bought here into New Hampshire is not lawful.

New Hampshire has no adult-use retail market and possession there is not treated as it is here. Separately, cannabis remains federally controlled, and transporting it across a state line is a federal matter regardless of the law on either side.

Passengers and open containers

The prohibition attaches to the passenger area, not to the driver alone. A passenger holding an opened package is an open container in the passenger area.

This matters more than people expect on a group trip, where one person drives and everybody else assumes the rules are the driver’s problem. They are not. Everything with a broken seal goes in the trunk, whoever it belongs to.
